Privacy Policy
This policy explains what Markframe collects through its portals and trademark services, why it is needed, who may receive it and the choices available to you.
1. Scope and accountability
This policy describes how Markframe handles personal information through markframe.app, its trademark intake, customer and organization portals, reports, communications and support operations. Markframe is accountable for personal information under its control, including information processed by service providers on its behalf.
2. Information we collect
We may collect your name, email address, telephone number, account credentials and verification status; organization and membership information; proposed trademarks, logos, business descriptions, goods and services, operating regions, owner/applicant details and correspondence information; candidate searches, decisions, application drafts, authorizations, case messages, uploaded documents and evidence; order, payment status, credits, refunds and official-fee records; support communications, consent history and privacy requests; and technical information such as IP address, browser, device, timestamps, security events and audit activity. Payment-card numbers are entered with our hosted payment provider and are not stored by Markframe.
3. Why we use information
We use personal information to create and secure accounts; save and resume intake; verify email; search and organize trademark information; prepare reports and applications; calculate fees; process purchases; act on customer-authorized filing instructions; maintain documents, messages, receipts and case history; monitor official records and deliver alerts; support users and organizations; detect abuse and protect the service; keep audit and financial records; improve reliability and accessibility using appropriately limited data; comply with law; and establish, exercise or defend legal claims. We will identify and seek any consent required before using information for a materially new purpose.
4. Consent and communications
Submitting information and requesting a service authorizes processing reasonably necessary to provide that service. Optional marketing consent is separate and is not required to purchase or use Markframe. Transactional messages may include verification, security, payment, case, filing and service notices. Marketing messages identify the sender and provide an unsubscribe mechanism. You may withdraw marketing consent at any time; withdrawal does not affect processing already completed or information that must be retained for legal, security or transaction purposes.
5. When we disclose information
We may disclose limited information to infrastructure, storage, email, analytics, security, payment and support providers acting under contract; to CIPO or another official body when you expressly authorize a filing or related action; to members of an organization workspace according to their role; to a professional collaborator only when access is expressly granted; in a business transaction subject to appropriate confidentiality safeguards; or where required or permitted by law. We do not sell personal information or use public trademark-record contact details for unrelated marketing.
6. Public trademark information
Trademark applications and registrations may become public through CIPO. Information submitted to an official authority is governed by that authority’s publication and retention practices. Markframe limits unnecessary display of personal addresses in its interface, but cannot make information private after it is included in an official public record.
7. Service providers and international processing
Authorized providers may process information in Canada or other countries. Information processed outside your province or Canada may be accessible to courts, governments or law-enforcement authorities under local law. Markframe remains responsible for information transferred to processors and uses contractual, access and security controls appropriate to the service and sensitivity.
8. Retention and deletion
We retain information only as long as reasonably needed for the purposes described, including providing the service, maintaining reproducible reports and authorization evidence, resolving disputes, meeting tax/accounting obligations, preventing fraud and complying with law. Retention varies by record type and case status. When information is no longer required, it is deleted, anonymized or securely destroyed. Backup copies may remain until their scheduled expiry. A deletion request may not remove official public records or records we must lawfully retain.
9. Safeguards
Markframe uses measures proportionate to sensitivity, including encryption in transit, access controls, authenticated case links, password hashing, mandatory multi-factor authentication for staff, role restrictions, audit events, file type and size validation, checksums, separated payment handling and controlled submission records. No internet service is risk-free. If a breach creates a real risk of significant harm, Markframe will investigate, document and provide legally required notifications.
10. Your rights and choices
Subject to applicable law, you may request access to personal information held about you, an account of its use and disclosure, correction of inaccurate information, export, withdrawal of consent, or deletion. We may verify identity before responding and may withhold information where an exception applies. If access is refused, we will explain the reason where permitted. You may challenge Markframe’s compliance without retaliation.
11. Cookies and analytics
Markframe may use essential storage for sessions, security and saved progress. Any optional analytics or advertising technology must be configured to avoid trademark wording, owner details, uploaded media and other sensitive case content. Where consent is legally required, optional technology will not be activated before that consent.
12. Children
Markframe is intended for people capable of entering a binding service agreement and is not directed to children. Do not submit a child’s personal information unless you have lawful authority and it is necessary for an expressly supported service.
13. Changes to this policy
We may update this policy as the service or law changes. The effective date will be revised, and material changes will be brought to affected users’ attention. Where required, Markframe will request fresh consent before a new use or disclosure.
